This document "Privacy Policy" (hereinafter referred to as the Policy) represents the rules for the use by IE Petrunenko A.A. (OGRNIP 317237500050521, hereinafter referred to as the Contractor) of personal data of the User (Customer) of the WAMM.chat software, located on the Internet at: https://wamm.chat.
1. General Provisions
1.1. Consent to the processing of personal data is provided by the User voluntarily, consciously and in explicit form by filling out and confirming a separate form of consent to the processing of personal data. Without providing such consent, use of the service is not possible.
1.2. The User has the right at any time to withdraw consent and request deletion of their personal data by sending an appropriate notification to the Contractor by submitting a request to the support service. Personal data is also deleted automatically in accordance with clauses 2.6-2.7.
1.3. Personal data of Users is processed and stored on servers located on the territory of the Russian Federation.
1.4. The Contractor is included in the register of personal data operators of Roskomnadzor of the Russian Federation, registration number 23-25-149163. Processing of personal data is carried out in accordance with the requirements of Federal Law No. 152-FZ of July 27, 2006 "On Personal Data".
2. Personal Information
2.1 Personal data includes:
2.1.1 Information that the User provides about themselves independently when using the website https://wamm.chat, during registration or authorization, when concluding a contract, as well as in the process of further use of the website https://wamm.chat, including telephone numbers, email addresses, message texts, files and other information that is necessary for the Contractor to correctly document contractual legal relations and for the Contractor to fulfill obligations within the framework of providing the service of access to the Software based on the offer agreement.
2.1.2. Data that is transmitted automatically depending on the settings of the User's software in anonymized form.
2.2. The Contractor has the right to establish requirements for the composition of the User's Personal information that must be provided for use of the Software.
2.3. The Contractor does not verify the accuracy of the Personal information provided, believing that the User acts in good faith, prudently and makes all necessary efforts to keep such information up to date.
2.4. The User is aware of and accepts the possibility of using third-party software on the website https://wamm.chat, as a result of which such parties may receive and transmit the specified data in anonymized form: systems for collecting visit statistics Google Analytics, Yandex.Metrica; social plugins (blocks) of social networks. The specified third-party software includes: browser data (type, version, cookies); operating system data (type, version, screen resolution); request data (time, referral source, IP address). The composition and conditions for collecting anonymized data using third-party software are determined directly by their copyright holders.
2.5. The Contractor is not responsible for the procedure for using the User's Personal information by third parties with whom the User interacts within the framework of using the Software.
2.6. In case of non-payment of remuneration after the expiration of the access period to the Software, after 14 days of non-use, the User's account data in the Software is subject to deletion, all accumulated personal information is deleted, including dialog lists, correspondence history, files, with the exception of Software operation logs.
2.7. At any time, the User can independently delete personal information from the Software; such functionality is provided in the Software Settings section. All accumulated personal information is deleted from the Software, including dialog lists, correspondence history, files, with the exception of certain Software operation logs (information about the fact of registration, payments and others).
3. Purposes of Personal Information Processing
3.1. The Contractor processes, including collects and stores, those Personal data that are necessary for registering the User's personal account, ensuring the operation of the message transmission mechanism, and concluding and executing an agreement with the User. Requests to the support service are accepted using the Software and email.
3.2 The User's consent to the processing of personal data is provided for the purposes of: correct documentation of legal relations between the User and the Contractor; ensuring the Contractor's fulfillment of its obligations within the framework of legal relations between the User and the Contractor and its provision of the service.
3.3. The User's consent to the processing of personal data is provided for carrying out any actions with respect to personal data that are necessary or desired to achieve the above purposes, including (without limitation) collection, systematization, accumulation, storage, clarification (updating, modification), use, anonymization, blocking, cross-border transfer of personal data, transfer of personal data using any data transmission sources, as well as carrying out any other actions with personal data provided for by the current legislation of the Russian Federation.
3.4. The legal bases for processing personal data are:
- execution of an agreement to which the User is a party (clause 2 of part 1 of Article 6 of the Federal Law "On Personal Data");
- consent of the User to the processing of their personal data (clause 1 of part 1 of Article 6 of the Federal Law "On Personal Data");
- execution of the requirements of the legislation of the Russian Federation (clause 2 of part 1 of Article 6 of the Federal Law "On Personal Data").
4. Requirements and Measures for Protection of Personal Information
4.1. The Contractor takes necessary legal, organizational and technical measures to protect the User's personal data from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as other unlawful actions.
4.2. Measures include, but are not limited to: use of encryption and protection of communication channels; control of employee access to personal data; regular security audits and monitoring.
4.2. The Contractor has the right to transfer Personal information to third parties, in addition to clause 2.4, in the following cases:
4.2.1. Upon request of a court or other authorized government agency within the procedure established by law;
4.3. In order to improve the quality of the Service and ensure the possibility of legal protection, the Contractor has the right to store log files of actions performed by the User within the framework of using the Software.
5. Changes to the Privacy Policy
5.1. This Policy may be changed or terminated by the Contractor unilaterally without prior notice to the User. The new version of the Policy comes into force from the moment of its posting on the Website https://wamm.chat, unless otherwise provided by the new version of the Policy.
5.2. The current version of the Policy is located on the Contractor's Website on the Internet at https://wamm.chat/doc/conf.
